Effective this past January, Rhode Island joined the growing "ban the box" movement which prohibits employers from making inquiries regarding criminal records in certain circumstances. The "ban the box" law, codified in Rhode Island General Law 28-5-7(7), prohibits an employer from inquiring about whether the job applicant has been arrested, charged with, or convicted of any crime.
However, the "ban the box" law is not as concrete as it may seem. With so much media publicity regarding the law, it may come as a surprise for many to learn that Rhode Island's "ban the box" law does NOT prohibit employers from inquiring about his or her criminal convictions at the first interview or at any times thereafter.
